Biden-Harris Administration Issues Landmark National Security Memorandum on AI
On October 24, President Biden issued the first National Security Memorandum (NSM) on AI. The NSM on AI comes almost one year after President Biden signed the Executive Order on Safe, Secure, and Trustworthy Artificial Intelligence.
The NSM is a balancing act that promotes AI adoption, experimentation, and development while acknowledging concerns about its downsides and potential for malfeasance when used by irresponsible actors. The primary goal of the order is to put up safeguards for U.S. AI technologies and “maintain a strategic advantage on the technology” against competing governments like China, per The Financial Times. According to the White House briefing room, the NSM aims to “galvanize federal government adoption of AI to advance the national security mission,” namely the “track[ing] and counter[ing] adversary development and use of AI for national security purposes.” This includes gathering counterintelligence, cybersecurity information, and logistics on competitors’ operations to safeguard U.S. national security and innovation.
The edict also addresses ethical concerns about AI’s potential to infringe on First Amendment protections. The NSM on AI emphasizes that all AI technologies deployed and measures taken by U.S. intelligence agencies and the Pentagon must adhere to “democratic values” and uphold “human rights, civil rights, civil liberties and privacy.” Furthermore, the memorandum formally designates the AI Safety Institute as these agencies' primary contact and inspector.
